  3. With Failure to Warn claims, which often involve improper or inadequate labeling, we must show that the manufacturer neglected to warn of latent dangers encountered during a foreseeable use of its product (whether intended or not) of which it knew or should have known, all of which culminated in the consumer’s injury. 
  4. Breach of Implied or Express Warranty cases are generally based on failure of the product to meet expectations, based upon contract or representations made by the manufacturer, distributor or seller.
